Terms of Service
These terms govern use of Index POS, a point of sale and business management platform provided by Index Hosting Limited ("Index"). By creating an account you agree to them on behalf of the business the account is used for.
Your account
You must give accurate details, keep your login credentials confidential, and tell us promptly if you believe someone else has access to your account. The person who creates a business is its owner and is responsible for the staff invited into it and for everything they do under their roles.
Plans and subscription fees
New businesses start on a free trial. After the trial, continued use requires a paid subscription on one of the plans shown in the app, billed monthly or annually where annual billing is offered. Fees are shown in the app before you pay and are charged through our payment provider, including mobile money.
Plan prices and the limits attached to each plan (users, branches and products) may change. We will tell owners before a change affects them. A subscription can be cancelled at any time and runs to the end of the period already paid for.
If a subscription is not paid, access is suspended: sales can no longer be recorded, but business data is preserved so it can be restored once payment is made.
What you may not do
You may not use the platform for unlawful activity, attempt to access another business's data, interfere with the service or its security, resell access without our agreement, or use the fiscal reporting features to misstate sales to a tax authority.
Business data and your responsibilities
The data you enter belongs to you. You are responsible for its accuracy, for keeping your own records where required by law, and for making sure your staff use the platform correctly. Where electronic fiscal reporting is enabled, it is your responsibility to keep the tax credentials you provide current and correct.
Availability and changes
We aim to keep the platform available at all times but do not guarantee uninterrupted operation. Maintenance, outages and emergency repairs may cause downtime. We may add, change or withdraw features as the product develops, and will give notice where a change materially affects a business.
Liability
The platform is provided without warranties beyond those stated here. To the extent the law allows, Index is not liable for lost profits or for losses arising from incorrect data entered by users, and its total liability to a business is limited to the fees that business paid in the twelve months before the claim.
Ending the agreement
You may stop using the platform and cancel your subscription at any time. We may suspend or close an account that breaches these terms, or where required by law. On closing, a business may request its data before deletion.
